01 Definitions
"Software" refers to the Volter desktop application. "Subscription" refers to the recurring payment plan granting access to the Software. "License" refers to the digital key that activates the Software. "User" refers to any individual or entity using the Software. "Asenko" refers to Asenko BV, the developer of Volter. "Paddle" refers to Paddle.com Market Limited, the merchant of record for all payments.
02 License Grant
Subject to an active Subscription, Asenko grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on one machine. This is a license, not a sale. You do not acquire any ownership rights in the Software.
The Software is also available as a free version with limited functionality. The free version is subject to these same Terms, except that no Subscription or payment is required. Asenko may change or discontinue the free version at any time.
03 Permitted Use & Restrictions
You may use the Software to create electrical schematics for professional or personal purposes.
You may not:
- Reverse engineer, decompile, or disassemble the Software
- Share, lend, or transfer your License to another person or entity
- Copy, redistribute, or sublicense the Software
- Circumvent or tamper with the licensing mechanism
- Use a single License on more than one machine simultaneously
04 Subscriptions & Payment
Subscriptions are billed on a recurring basis (monthly or yearly) through Paddle, which acts as the merchant of record. Paddle handles all payment processing, tax collection, refunds, and billing disputes. By subscribing, you also agree to Paddle's terms of service. Prices may change with reasonable notice. If a payment fails, your License may be suspended until the payment issue is resolved.
05 Refunds
A free version of the Software is available to evaluate its functionality before purchasing a Subscription. You may request a refund within 14 days of purchase, provided your License has not yet been activated. Once the License has been activated, no refund is available, as immediate delivery of digital content waives the right of withdrawal under Article VI.53, 13 of the Belgian Code of Economic Law (see section 11: Right of Withdrawal). To request a refund, contact info@volter.be. Approved refunds are processed by Paddle, the merchant of record.
06 AREI/RGIE Compliance Disclaimer
Volter is a tool designed to assist electricians in creating electrical schematics. However, Volter does not guarantee that any schematic created with the Software is compliant with AREI/RGIE regulations or any other applicable standards. The User bears full and sole responsibility for verifying the correctness and regulatory compliance of their work. Asenko shall not be held liable for any damages, fines, or consequences arising from non-compliant schematics.
07 Intellectual Property
The Software, including its code, design, and documentation, is the exclusive property of Asenko BV and is protected by copyright and intellectual property laws.
You retain full ownership of all schematics, projects, and data you create using the Software. Asenko does not access, collect, or claim any rights over your work.
08 Updates & Availability
Asenko may release updates to the Software that add, modify, or remove features. Updates are included in your Subscription at no extra cost. Asenko does not guarantee uninterrupted availability of the licensing and activation services, though we make reasonable efforts to maintain their reliability.
09 Warranty Disclaimer & Limitation of Liability
The Software is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or absence of errors. Asenko does not warrant that the Software will meet your specific requirements or operate without interruption.
To the maximum extent permitted by Belgian law, Asenko shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Software. This includes, without limitation, damages related to electrical installations, regulatory non-compliance, or loss of data. Asenko's total liability shall not exceed the total Subscription fees paid by you in the 12 months preceding the claim.
10 Termination
Your License is active as long as your Subscription is in good standing. Your License will be terminated if your Subscription ends (by cancellation or non-renewal), you fail to pay, or you violate these Terms. Upon termination, you must stop using the Software. Any schematics or data you created remain yours.
11 Right of Withdrawal
Volter is delivered as digital content that is not supplied on a physical medium. By completing your purchase and receiving your activation key, you consent to immediate delivery and acknowledge that you lose your right of withdrawal once the License has been activated. This is in accordance with Article VI.53, 13° of the Belgian Code of Economic Law.
12 Privacy
Your use of the Software is also governed by our Privacy Policy, which describes how we collect and process your personal data.
13 Governing Law
These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms shall be submitted to the competent courts of Belgium.
14 Force Majeure
Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, power outages, cyberattacks, government actions, or pandemics. Affected obligations are suspended for the duration of the event.
15 Changes to These Terms
Asenko may update these Terms from time to time. We will notify you of significant changes via email. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.
16 General Provisions
These Terms constitute the entire agreement between you and Asenko regarding the use of the Software and supersede any prior agreements or communications on this subject.
If Asenko does not enforce any provision of these Terms, this does not constitute a waiver of the right to enforce it in the future.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Nothing in these Terms is intended to limit or exclude any rights you may have under mandatory Belgian consumer protection law.
