Terms of Service

01 Definitions

"Software" refers to Volter, both the desktop application and the web version at app.volter.be. "Account" refers to the personal account you sign in with and to which your Subscription is tied. "Subscription" refers to the recurring payment plan granting access to the Software. "License" refers to the right to use the Software for as long as your Subscription is active. "User" refers to any person or entity using the Software. "Asenko" refers to Asenko BV, the developer of Volter. "Paddle" refers to Paddle.com Market Limited, the merchant of record for all payments.

02 License Grant

Subject to an active Subscription, Asenko grants you a limited, non-exclusive, non-transferable, revocable licence to use the Software, both the installable version on the devices you use yourself and the web version. The licence is personal and covers one named user. This is a licence, not a sale. You acquire no ownership rights in the Software.

Without an active Subscription you may use the Software to open, view and export existing projects, but not to create projects or save changes. Asenko may change or discontinue that access at any time.

03 Permitted Use & Restrictions

You may use the Software to create electrical schematics for professional or personal purposes.

You may not:

  • Reverse engineer, decompile, or disassemble the Software
  • Share, lend, or transfer your Account to another person or entity
  • Copy, redistribute, or sublicense the Software
  • Circumvent or tamper with sign-in or with the check on your Subscription
  • Let more than one person use your Account

04 Subscriptions & Payment

Subscriptions are billed on a recurring basis (monthly or yearly) through Paddle, acting as merchant of record. Paddle handles all payments, tax collection, refunds and billing disputes. By subscribing you also agree to Paddle’s terms of use. Prices may change with reasonable prior notice. If a payment fails, your access may fall back to read-only until the payment issue is resolved.

05 Refunds

A free version of the Software is available to evaluate its functionality before purchasing a Subscription. You may request a refund within 14 days of purchase, provided you have not yet used the paid features. Once you start working with the paid features after taking out your Subscription, no refund is possible, as the immediate delivery of digital content causes the right of withdrawal to lapse under article VI.53, 13° of the Belgian Code of Economic Law (see section 13: Right of Withdrawal). To request a refund, contact info@volter.be. Approved refunds are processed by Paddle, the merchant of record.

06 AREI/RGIE Compliance Disclaimer

Volter is a tool designed to assist electricians in creating electrical schematics. However, Volter does not guarantee that any schematic created with the Software is compliant with AREI/RGIE regulations or any other applicable standards. The User bears full and sole responsibility for verifying the correctness and regulatory compliance of their work. Asenko shall not be held liable for any damages, fines, or consequences arising from non-compliant schematics.

07 Intellectual Property

The Software, including its code, design, and documentation, is the exclusive property of Asenko BV and is protected by copyright and intellectual property laws.

You retain full ownership of every schematic, project and piece of data you create with the Software. Asenko claims no rights in it and does not use your work for its own purposes. We store it in order to provide the service, and we look at it only when you ask us for support or when the law requires us to.

08 Your projects and storage

Projects you save are stored in your account, so you can open them on every device you sign in on.

You can export any project as a .vschema backup at any time, and we recommend doing so regularly: your own backup is the only one entirely under your control. We make every effort to keep your projects available, but we do not guarantee uninterrupted availability or protection against data loss.

09 Processing your clients’ personal data

Your projects may contain personal data about your clients, such as a name and an address. For that data you are the controller and Asenko acts as processor. This clause serves as the data processing agreement within the meaning of article 28 GDPR and lasts for as long as you use the Software.

Asenko processes that data solely to provide the service to you and in accordance with your instructions, not for its own purposes. We keep it confidential, impose the same obligation on anyone with access on our behalf, and take appropriate technical and organisational measures to protect it.

For this data we rely on the service providers listed in our privacy policy. If we engage a new sub-processor, we will inform you in advance and you may object.

We will assist you, within what is reasonable, with requests from your clients about their data, with a data breach, and with a data protection impact assessment. We will notify you of a breach without undue delay. On request we will give you the information you need to verify that we comply with these arrangements.

You can export and delete your projects at any time. If you delete your account, we delete the projects it holds.

10 Updates & Availability

Asenko may release updates to the Software that add, modify, or remove features. Updates are included in your Subscription at no extra cost. Asenko does not guarantee uninterrupted availability of the sign-in and syncing services, but we make reasonable efforts to ensure their reliability.

11 Warranty Disclaimer & Limitation of Liability

The Software is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or absence of errors. Asenko does not warrant that the Software will meet your specific requirements or operate without interruption.

To the maximum extent permitted by Belgian law, Asenko shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Software. This includes, without limitation, damages related to electrical installations, regulatory non-compliance, or loss of data. Asenko's total liability shall not exceed the total Subscription fees paid by you in the 12 months preceding the claim.

12 Termination

Your Licence is active for as long as your Subscription is valid. Your Licence ends when your Subscription ends (through cancellation or non-renewal), when you fail to pay, or when you breach these Terms. After your Subscription ends you can still open and export your existing projects, but you cannot create projects or save changes. Your projects are kept for as long as your account exists. Schematics or data you have created remain your property.

13 Right of Withdrawal

Volter is delivered as digital content that is not supplied on a physical medium. By completing your purchase and signing in, you consent to immediate delivery and acknowledge that you lose your right of withdrawal as soon as you start working with the paid features. This is in accordance with article VI.53, 13° of the Belgian Code of Economic Law.

14 Privacy

Your use of the Software is also governed by our Privacy Policy, which describes how we collect and process your personal data.

15 Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these Terms shall be submitted to the competent courts of Belgium.

16 Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including but not limited to natural disasters, power outages, cyberattacks, government actions, or pandemics. Affected obligations are suspended for the duration of the event.

17 Changes to These Terms

Asenko may update these Terms from time to time. We will notify you of significant changes via email. Continued use of the Software after changes take effect constitutes acceptance of the updated Terms.

18 General Provisions

These Terms constitute the entire agreement between you and Asenko regarding the use of the Software and supersede any prior agreements or communications on this subject.

If Asenko does not enforce any provision of these Terms, this does not constitute a waiver of the right to enforce it in the future.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Nothing in these Terms is intended to limit or exclude any rights you may have under mandatory Belgian consumer protection law.
